1. Who we are
NapNodes is a hosting service for video game servers and applications provided by Marco Napierski (NapNodes), tax ID (NIF) X9497973P, with its registered address at Calle Buganvillas 1, 38300 La Orotava, Santa Cruz de Tenerife.
Contact for customers, for authorities and for notices about illegal content: rafi007napi@hotmail.com. We answer in Spanish and English. This is our single point of contact for the purposes of Articles 11 and 12 of Regulation (EU) 2022/2065 on Digital Services.
By buying, you accept these terms, the Acceptable Use Policy, the Refund Policy and the Privacy Policy. If anything in these documents contradicts a right the law gives you as a consumer, the law prevails.
2. Who can buy
To buy you must be of legal age. If you are a minor, your mother, father or guardian can buy for you, and will be the holder of the service and responsible for its use.
Your account details must be truthful and up to date: we use them to invoice you and to tell you about anything that affects your service.
You are responsible for the security of your account. Use a password of your own and turn on two-step verification. If someone else needs to manage your server, give them access as a sub-user from the panel instead of sharing your password. If you suspect unauthorised access, let us know as soon as possible.
3. What the service includes
We assign you the RAM, disk and processing capacity stated in your plan, on shared machines.
We do not oversell memory: your plan's RAM is reserved for you, and a node stops accepting new customers before it runs out. The occupancy of each node is public at napnodes.com/estado.
Each server has its own address under play.napnodes.com, so your players can connect without typing the port, and an additional port for add-ons such as a web map.
You manage the service from a web panel with console, files, backups, sub-users and restart.
When we create a Minecraft server, we generate the terrain around the spawn point in advance so that the first session runs smoothly, and we email you when it finishes. While it runs, which usually takes a couple of minutes, we give it more power than your plan if the node has headroom, and we may restart it once or twice, always with nobody connected. To do this we install the Chunky add-on, which you can delete whenever you like; on modded servers we remove it ourselves when we finish, so that it doesn't clash with yours. If you later rebuild the world, we generate it again in the same way.
4. Payment, renewal and non-payment
Services are paid in advance and renew automatically at the end of each period, unless you cancel beforehand from the customer area.
We issue the renewal invoice 7 days before the due date and send it to you by email.
If the due date passes without payment, the service is suspended after 2 days: your data is kept, but the server cannot be accessed. 14 days after the due date without payment, the service and all its data, backups included, are permanently deleted. We write to you when a payment fails, when the service is suspended and when it is deleted.
An order that is not paid within 7 days is cancelled at no cost.
If we change the price of your plan, we will give you at least 30 days' notice, and the new price will only apply from your next renewal. If you do not agree, you can cancel beforehand at no cost.
4a. Free server
When there is room to spare, we offer a free server for any of our games, without asking for a card and with no end date. It is one per person, for the game you choose: another one may not be requested with another account, with another email or from the same connection. If we detect it, the second one is cancelled and deleted immediately. If there are no places left, you can join the waiting list: servers are created in order of arrival as soon as there is room, and we let you know by email. Paid servers always have priority: free servers only use the room left over.
The free server uses the memory that paying customers have not bought at that moment. It is started with the «Encender» (Start) button in the panel, which may ask you to confirm you are not a robot; starting it any other way is not allowed and the server switches itself off. If there is no room at that moment, you join a queue and, when your turn comes, you have a few minutes to start it; otherwise the turn passes to the next person. If people are waiting, free servers that have been on for more than an hour are switched off, with a prior warning. And if a paying customer needs the room, the free server is switched off to make way. Switching it off never deletes anything. Free Discord bots are not switched off for having no players, but they must be renewed every 7 days with the button in the panel; otherwise, they are switched off.
The free server switches itself off when it has had nobody connected for 20 minutes, and you start it again from the panel whenever you want to play. If nobody plays on it for 14 days in a row, it is deleted with its data; we email you 3 days before. If you move to any paid plan from «Mejorar» (Upgrade), the same server carries on with all its content, always on and with no queues, and from then on these terms apply to it like any other service.
The free server does not include backups and its disk is smaller than on paid plans. Its disk has a limit that cannot be exceeded: we email you when it is nearly full and, if it fills up, the game cannot save changes. As it is free, if a free server uses its CPU at the maximum continuously it is suspended automatically (see the Acceptable Use Policy).
5. Your content
Everything you upload or that is generated on your server —worlds, configurations, plugins, databases— is yours. We only process it to provide the service: storing it, transmitting it and making the backups you ask for. We do not use it for anything else.
You are responsible for what is done on your server, including what your players and users do, and for holding the rights or licences to what you install: mods, plugins, maps and any other third-party content.
Using a Minecraft server requires accepting Mojang's End User Licence Agreement (EULA) (aka.ms/MinecraftEULA). You accept it yourself when you buy, by ticking the box on the order, and in doing so you authorise us to leave it accepted on your server so that it starts first time. You are also responsible for complying with Mojang's commercial usage guidelines if you charge your players for anything.
6. Backups
Each server can keep up to 2 backups, which you create and restore yourself from the panel. We store them with care, but we do not guarantee that they can always be restored: a disk failure or a damaged file can make it impossible.
That is why we recommend that you regularly download a copy of whatever you don't want to lose and keep it outside our servers. You can do this whenever you like, without asking permission.
When a service is deleted, through cancellation or non-payment, its data and its backups are deleted at the same time. Download them first if you want to keep them.
7. Migration and portability
If you are coming from another provider, we move your server at no cost. We need read access to your previous installation or a compressed archive of it; the move is done in parallel and your current service is not interrupted.
You can download a full copy of your data at any time from the panel, without requesting it or giving a reason. We do not make handing over your data conditional on you remaining a customer.
8. Cancellation
You can cancel at any time from the customer area, choosing between two options: at the end of the period already paid for, in which case the server keeps running until then, or immediately, in which case the server and its data are deleted at that moment.
Cancelling does not in itself give rise to a refund. When one is due is explained in the Refund Policy, which includes your 14-day right of withdrawal.
9. Availability, compensation and support
We commit to a monthly availability of 99.5% for the node your server is on. Maintenance announced at least 48 hours in advance and the causes in the following paragraph do not count.
If an unplanned outage of your node lasts one hour or more, we compensate you with one extra day of service for each full hour, up to a maximum of 30 days per incident. Ask for it by opening a ticket within 7 days of the outage.
The following are not considered service outages: failures caused by the customer's configuration, plugins, mods or code; attacks aimed at your server that exceed our protection; suspensions for non-payment or for breaching the policies; or cases of force majeure.
Support is provided from 12:00 to 00:00 UTC, every day. Outside those hours we only deal with incidents that leave an entire node without service. We tell you this before you buy so that you can decide with that information.
We support the infrastructure: that your server starts, that the network works and that the panel responds. We give you guidance with mods and plugins, but we do not configure complex installations for you or fix other people's code.
10. Suspension or termination by us
We may suspend or terminate a service for non-payment, for breaching these terms or the Acceptable Use Policy, for a security risk to other customers or to our network, or because of a legal obligation.
Unless the case is serious or urgent, we will warn you first and give you a reasonable period to put it right. We will always explain the reason in writing, with the facts we rely on, and you will be able to reply to that decision through the same channel.
If one day we stop offering a service, we will give you at least 30 days' notice and refund the proportional part of the paid period that you do not get to use.
11. Notices about illegal content
If you believe there is illegal content on a server we host, let us know at rafi007napi@hotmail.com. Include: why you believe it is illegal, exactly where it is (server address, file or screenshot), your name and email, and a statement that the information is accurate and given in good faith. In cases of child sexual abuse you do not need to identify yourself.
We will review the notice diligently, tell you what we decide and, if we remove content or suspend a service, we will inform the affected customer of the reasons and of how they can appeal. If we detect signs of a crime that endangers someone's life or safety, we will report it to the authorities.
12. Liability
We are liable for the damage we cause you by not providing the service as described. Except in cases of wilful misconduct or gross negligence, and unless the law does not allow it, our total liability is limited to the amount you have paid for the affected service in the three (3) months before the event giving rise to the claim.
We are not liable for damage caused by your content, your configuration or the use third parties make of your server, nor for lost profits of businesses you build on our service.
We are not responsible for delays or failures caused by events beyond our reasonable control, such as disasters, general power or network outages, or attacks that exceed the available protections.
Nothing above limits the rights that consumer protection law gives you.
13. Our brand and our software
The NapNodes name, its logo, this website and the proprietary software we use to provide the service are ours. You may not use them to present yourself as us, or try to access parts of the system that are not yours.
14. Changes to these terms
We may change these terms by giving you thirty (30) days' notice by email. If you do not agree with the change, you can cancel at no cost before it takes effect.
15. Applicable law and complaints
These terms are governed by Spanish law. If you buy as a consumer, you can bring a claim before the courts of your place of residence.
First of all, write to us: almost everything is solved with a message. We are not currently signed up to any arbitration or alternative consumer dispute resolution scheme.
If you make a complaint and we do not resolve it in your favour, we will tell you in writing of an accredited alternative consumer dispute resolution body you can turn to, and whether we will take part in that procedure.
